Terms of Service

The short version
Kithpace reminds you to message people and opens WhatsApp with the text ready. It never sends anything on your behalf. Free stays free; paid tiers are bought through Google Play, and refunds go through Google. Use it for people you actually know — not for bulk or unsolicited messaging.
1. Agreement
Kithpace is published by Evma Pte. Ltd., a company registered in Singapore
(“we”, “us”). These terms apply to the Kithpace Android app
(com.kithpace.app) and to kithpace.com. By installing or using the
app you accept them. If you do not agree, uninstall the app.
2. What Kithpace does — and does not do
Kithpace is a personal reminder tool. It tracks how long it has been since you last recorded a conversation with someone and reminds you at a rhythm you choose. When you act on a reminder, it opens WhatsApp with a message pre-filled.
Kithpace never sends a message. The final send is always your own tap, inside WhatsApp. We are not a messaging service and we do not transmit, store, or deliver your messages.
Kithpace is not affiliated with, endorsed by, or connected to WhatsApp LLC or Meta Platforms, Inc. WhatsApp is their trademark. Your use of WhatsApp is governed by their terms, and they may change how third-party links behave at any time.
3. Acceptable use
You agree not to use Kithpace to:
- send unsolicited bulk messages, spam, or marketing to people who have not asked for it;
- harass, stalk, threaten, or repeatedly contact someone who has asked you to stop;
- store or process other people’s contact details unlawfully, or in breach of any privacy law that applies to you;
- break WhatsApp’s own terms of service; or
- reverse engineer, resell, or redistribute the app.
You are responsible for the phone numbers you add and for the messages you choose to send. If you add other people’s details — particularly for business use — complying with the privacy laws that apply to you is your responsibility, not ours.
4. Plans and payment
Kithpace has a free tier that does not expire. Paid tiers are sold through Google Play Billing:
- Plus is a one-time purchase. You pay once and keep it — there is no renewal.
- Business is a subscription, billed monthly or annually, and it renews automatically until you cancel.
Prices are shown in the app and charged by Google in your local currency. Manage or cancel a subscription in Google Play › Subscriptions; cancelling stops future renewals and you keep access until the paid period ends.
Purchases are tied to your Google account, so “Restore purchases” in Settings brings them back on a new device without any account on our side.
5. Refunds
Refunds are handled by Google Play under Google’s refund policy, because Google — not us — is the merchant of record. Request one through Google Play. If Google declines and you believe there are grounds, write to hello@kithpace.com and we will help where we can, though the final decision rests with Google.
6. Your data
Your data lives on your device and nowhere else — see the Privacy Policy. This has a consequence worth stating plainly: we cannot recover your data. If you lose, reset, or wipe your phone, or uninstall the app, the data is gone. There is no cloud copy for us to restore. The Business plan can export your data from Settings if that matters to you.
7. Availability
Kithpace is provided as it is. We do not guarantee it will be free of defects, or that reminders will always fire exactly on time — Android may delay or suppress background work depending on battery optimisation, Doze, and manufacturer power management, which are outside our control. Treat Kithpace as a helpful nudge, not a guaranteed alarm.
8. Disclaimer and liability
To the fullest extent permitted by law, Kithpace is provided “as is” and without warranties of any kind, express or implied, including merchantability and fitness for a particular purpose.
We are not liable for indirect or consequential loss, for lost data, or for any consequence of a reminder arriving late or not at all. Where liability cannot be excluded by law, it is limited to the amount you paid for the app in the twelve months before the claim.
Nothing here limits rights you have under consumer law that cannot be excluded by agreement.
9. Changes and termination
We may update these terms; the date at the top will change and material changes will be noted in release notes. You may stop using Kithpace at any time by uninstalling it. We may discontinue the app, in which case the version already on your device keeps working — it needs no server to run.
10. Governing law
These terms are governed by the laws of Singapore, and the courts of Singapore have exclusive jurisdiction, without affecting any mandatory consumer protections in your country of residence.
